In pre-pandemic years, last-minute taxpayer queues went around the block and then some. The Kenya Revenue Authority (KRA) iTax systems crashed and many were fined for their tardiness in the filing. Yet unknown to many the required filing can be done from January in the year following the year the income was earned.
Taxation in Kenya is for the purpose of financing the government’s planned activities. It is Article 209 of the Constitution of Kenya 2010 that grants powers for the government to impose taxes as a revenue source by both the national and the county governments. While it remains a vital source of revenue, there have been continuous challenges for KRA to ensure that most taxpayers comply with taxation requirements. It doesn’t help that a myriad of new taxes has been introduced in the last few years.
In 2020, we saw the introduction of the Turnover and Presumptive tax. Then The Digital Service Tax (DST) then came into effect early this year which makes it even more challenging to understand what is required from different sets of taxpayers. However, ignorance is not an excuse, and compliance is a must.
Tax compliance is defined as the process of filing returns, declaring correct tax and payments by the deadlines set. It requires awareness & education for individuals (employees, consultants) and enterprises (start-ups, business) to be confident in their knowledge of tax laws and regulations.
